EXCEPT AS EXPRESSLY PROVIDED, OUR SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING:
- Merchantability and fitness for a particular purpose
- Accuracy, reliability, or completeness of AI outputs
- Uninterrupted or error-free operation
- Compatibility with all systems or environments
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- Aikyo.AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages
- Our total liability shall not exceed the amount paid by you for the specific service giving rise to the claim
- We are not responsible for decisions made based on AI-generated outputs
- We are not liable for third-party services or integrations
9. Indemnification
You agree to indemnify, defend, and hold harmless Aikyo.AI and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:
- Your use of our services
- Your violation of these Terms
- Your violation of any third-party rights
- Any content or data you provide to us
10. Termination
Either party may terminate the relationship:
- With written notice as specified in service agreements
- Immediately upon material breach by the other party
- If required by law or regulatory action
Upon termination:
- All licenses granted will immediately terminate
- You must cease using our services and deliverables (unless fully paid)
- We will return or destroy your confidential information upon request
- Outstanding payments become immediately due
11. Data Processing
When processing data as part of our services:
- We comply with applicable data protection regulations (GDPR, CCPA, etc.)
- We implement appropriate security measures
- We process data only as directed by you and as necessary for service delivery
- Additional data processing terms may apply as specified in service agreements
12. JIKARA Mobile Application Terms
The following additional terms apply to users of the JIKARA Japanese learning mobile application ("JIKARA App").
12.1 App License
Subject to these Terms, Aikyo.AI grants you a limited, non-exclusive, non-transferable, revocable license to download and use the JIKARA App on your personal mobile device for personal, non-commercial Japanese language learning purposes.
12.2 Subscription Tiers
JIKARA offers the following subscription options:
- Free Tier: Limited access including 1 lesson per day, first 5 lessons, N5 level only, basic session reports
- Pro (¥1,480/month or ¥11,800/year): Unlimited lessons, all JLPT levels (N5-N1), full AI reports, tutor mode, voice selection, free conversation, 1 streak freeze per month
- Career (¥3,980/month or ¥39,800/year): All Pro features plus business Japanese scenarios, weekly AI progress summaries, 3 streak freezes per month
Prices are in Japanese Yen (JPY) and may vary by region. Actual pricing is displayed in your app store.
12.3 Billing and Payments
- Subscriptions are billed through Apple App Store or Google Play Store
- Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
- Your account will be charged for renewal within 24 hours prior to the end of the current period
- You can manage subscriptions and turn off auto-renewal in your app store account settings
- No refunds are provided for partial subscription periods, except as required by applicable law
12.4 Free Trial
If offered, free trials automatically convert to paid subscriptions unless cancelled before the trial ends. You will be charged the applicable subscription fee upon trial expiration.
12.5 User Content and Voice Data
- You retain ownership of your voice recordings and conversation content
- By using JIKARA, you grant us a limited license to process your voice recordings and text for the purpose of providing the learning service
- Your voice data is processed by third-party AI services (Groq, Anthropic, Google) solely for real-time transcription, conversation, and speech synthesis
- We do not use your personal voice data to train AI models
12.6 AI-Generated Content
- JIKARA uses AI to generate Japanese conversation responses, corrections, and learning feedback
- AI-generated content is for educational purposes only and may contain errors
- We do not guarantee the accuracy, completeness, or appropriateness of AI-generated responses
- AI feedback should not be considered a substitute for professional language instruction
- JLPT level recommendations and fluency scores are estimates and not official certifications
12.7 Acceptable Use
When using JIKARA, you agree NOT to:
- Use the app for any unlawful purpose
- Attempt to manipulate or abuse the AI conversation system
- Generate or elicit harmful, offensive, or inappropriate content through the AI
- Share your account credentials with others
- Circumvent subscription restrictions or usage limits
- Reverse engineer, decompile, or extract the app's source code or AI models
- Use automated systems or bots to interact with the app
- Record, redistribute, or commercialize AI-generated audio or content
12.8 Account Termination
We may suspend or terminate your JIKARA account if you:
- Violate these Terms or our Acceptable Use policy
- Engage in fraudulent activity or payment disputes
- Abuse the AI system or attempt to circumvent safety measures
You may delete your account at any time through the app. Account deletion is permanent and results in loss of all learning progress and data.
12.9 Service Availability
- JIKARA requires an active internet connection for all features
- We strive for high availability but do not guarantee uninterrupted service
- Features may be modified, added, or removed with reasonable notice
- Third-party service outages (Groq, Anthropic, Google) may temporarily affect functionality
12.10 App Store Terms
Your use of JIKARA is also subject to:
In case of conflict, app store terms take precedence for billing and download-related matters.
13. Modifications to Terms
We reserve the right to modify these Terms at any time. Changes will be effective upon posting to our website. Continued use of our services after changes constitutes acceptance of the modified Terms.
For material changes, we will provide notice via email or website notification. JIKARA App users will also receive in-app notifications for significant changes.
14. Governing Law and Dispute Resolution
These Terms are governed by the laws of India, without regard to conflict of law principles.
Any disputes arising from these Terms or our services shall be resolved through:
- Good faith negotiations between the parties
- Mediation, if negotiations fail
- Binding arbitration in accordance with applicable rules
The prevailing party shall be entitled to recover reasonable legal fees.
15. General Provisions
- Entire Agreement: These Terms, together with any service agreements, constitute the entire agreement between the parties

- Assignment: You may not assign your rights without our written consent
